WE ARE THE CHILDREN’S HAVEN (W.A.T.C.H)
SUPERVISED VISITATION PROGRAM AGREEMENT
___1. Both Parties MUST complete registration before a visit can be scheduled. The parties will be notified by telephone/text or email with the date and time the visits will begin.
___2. All registration fees are non-refundable. The registration fee of $50.00 will be assessed to each party.
___3. W.A.T.C.H has the right to deny services to a family if their participation poses a danger to her/him or others.
___4. All participants and guests are subject to the rules and regulations of W.A.T.C.H.
___5. W.A.T.C.H. are not a party to the case. If the private supervisor is unable to provide services in accordance with the Court order or the agreement of the parties, it is the responsibility of the parties to request the court to modify the order or reach a mutual agreement regarding the visits.
___6. Private visits will be scheduled in accordance with the Court Orders. If visits are not schedule in the Court Order then visits will be schedule by the W.A.T.C.H. director. All visits are scheduled subject to the availability of the private supervisor, parties and children.
Visitation locations: W.A.T.C.H director will approve all visit sites.
___7. All visits will occur in a public area, once approved by the W.A.T.C.H. director. The W.A.T.C.H. director and the private supervisor must approve all exceptions. Any changes in visitation location must be approved by the W.AT.C.H. director prior to the visit. If an agreement is not reached then the normal place/or scheduled location will stay in effect.
___8. Private visit requests must be submitted at lease 72 hours in advance of a scheduled visit.
___9. Due to the liability issues, all travel of the children/child requires the approval of the W.A.T.C.H. director and the private supervisor.
___10. All guests must be named in the Court Orders or agreed upon by the parties, the W.A.T.C.H. director and the private supervisor. The number of guests will be limited. The W.A.T.C.H has the final say to any guests during the visit.
GUESTS: W.A.T.C.H director will approve all guests and whether an additional supervisor will be needed. Fees will be confirmed prior to setting up the visit.
___11. All guests are required to follow the same rules and regulations of the W.A.T.C.H. program regarding conversations, cell phone usage and photos. Guest fees are $10.00 per hour.
___12. Visits will be terminated if unapproved guests show up during a visit.
___13. Arrival and departure times are as follows: All CP(custodial parties) will arrive and depart at the scheduled visit times. All NCP(non-custodial parties) will arrive 10 minutes before the scheduled visit and depart 10 minutes after the custodial party has departed with the child(ren)
___14. No money is to be given to the children unless prior approval is received from the W.A.T.C.H. program director.
___15. The W.A.T.C.H. program and/or its director and/or the private supervisor are not responsible for any lost or damages items brought to the visit.
___16. In order to avoid possible contact between the custodial parent and non-custodial parent there will be NO CONTACT between the parties. No Contact means: No visible or physical contact. The visit may be terminated if either parent and/or party attempt to have visible or physical contact before, during or after a visit.
___17. CELL PHONES: No cell phones are allowed at the visit. Neither the child nor the visiting parent is allowed to talk on the phone and/or text unless approved by the W.A.T.C.H. program director and/or private supervisor. If the visiting party needs to use the cell phone for business, the W.A.T.C.H. program director and/or private supervisor must approve of the use of the cell phone and the visiting party must step aside so the children do not hear the conversation.
The W.A.T.C.H. program director will decide if and when the need for a visiting parent to use a cell phone, for either GPS or directions to a site.
___18. PHOTOGRAPHS AND VIDEOS: All photographs and video recordings must be approved before the visitation occurs. If one party does not agree to photographs or videos they will provide reasons for denying. The W.A.T.C.H. program director will make the final decision whether to allow photographs and video recordings.
___19. The private supervisor documents all visits. Each report will include the interactions between the parties and the children prior to, during and after the visit. All forms of communication between the parties, children and private supervisor will be included in the visitation report. All visitation reports and records will be confidential and can be obtained by subpoena and business record affidavit through the W.A.T.C.H program director. There is a fee for the service. Contact the W.A.T.C.H. program director for cost and location for service of subpoena. Reports are factual and not based on assessments or opinions.
___20. ALL forms of abuse or physical signs of abuse that are observed or reported by the child will be reported to the TFP.
___21. ALL FEES ARE TO BE PAID IN CASH BEFORE THE VISIT STARTS. Failure to pay with result in suspension of visits until paid in full.
___22. If a visit is terminated, the child (ren) and private supervisor will immediately leave the visitation location. The private supervisor will attempt to do this without upsetting the children. ALL visitation fees will not be refunded.
___23. If there is more than one child, two private supervisors may be required, with the standard fees applying for each supervisor.
The W.A.T.C.H. program director will decide if and when the need for two private supervisors will be required for any and all supervised visitations, with the standard fees applying for each supervisor.
___24 If the custodial party arrives late for pick up or drop off they will be charged on an hourly pro-rated charge for time late. The charge will be rounded up in 15 mins increments. The private supervisor will wait 15 minutes for either party to arrive.
___25 Visiting party is responsible for their children during the visits. The visiting party will be expected to discipline appropriately without the use of physical discipline.
___26. Neither party is to make derogatory comments or remarks about the opposite party before, during or after the visit in the presents of the child or private supervisor.
ALSO,
Neither party is to make any disparaging remarks regarding the other party’s family in the presence or within the hearing of the child, and from allowing the child to remain in the presence of anyone making such remarks
___27. All conversations that the private supervisor interprets or may interpret as an inappropriate conversation will not be permitted and could result in the visit being terminated. Whispering between the visiting party and the child(ren) will not be tolerated. If the visiting party is warned by the private supervisor that all conversations MUST be heard and the visiting party continues to whisper or talk in low mono tones, the visit may be terminated. If a child asks questions that may be interpreted as to lead to an inappropriate subject, the supervisor will assist the visiting party with responding to any questions the child may have.
THE SUPERVISOR WILL BE PRESENT AT ALL TIMES, WITH THE CHILD(REN). THE VISITING PARENT IS NOT TO BE ALONE WITH THE CHILD(REN) AT ANYTIME DURING THE VISIT.
___28. No conversations will be discussed during the visitation regarding litigation in the presence of the children or within the hearing of the children.
No conversations will be discussed during the visitation regarding the case, litigation, and complaints with the private supervisor. Any questions regarding the visitation, case, litigation or complaints will be directed to the W.A.T.C.H. program director.
___29. If the private supervisor suspects that visiting party is under the influence of drugs or alcohol the visit will be terminated. If the private supervisor suspects that the CP is under the influence of drugs or alcohol at drop off or pickup of the child the authorities will be notified and the private supervisor will request an alternative person drive the children home.
___30. Neither party will be allowed to pass notes, cards, and gifts to the opposing party through the children. The private supervisor maintains the right to inspect and examine anything brought to the visit by the visiting parent and/or the child(ren) if the private supervisor deems necessary for the safely of the child(ren) and the parties.
The W.A.T.C.H. program director and the private supervisor MUST approve any gifts to be given to the opposing party by the children. The visiting party must notify the program director before bring any gifts for approval before giving them to the children.
___31. ALL private visit CANCELLATIONS should be made at least 48 hours before the scheduled visit. CANCELLATIONS made after that time but before the day of the visit is subject to a cancellation fee of $100.00, which must be paid prior to another visit being scheduled.
If a party cancels a scheduled visit on the day of the visit and the supervisor has already departed for the visit, the entire fee for the visit is owed by the cancelling party and must be paid before another visit is scheduled. If the supervisor has not departed for the visit, a cancellation fee of $200.00 will be imposed and must be paid prior to the next scheduled visit.
FURTHER ALL FUTURE SCHEDULED VISITATION WILL BE PAID IN FULL 12 HOURS BEFORE ANY VISITS BY ZELLE.
___32. If a party is a NO SHOW to a visit, that party will owe the entire fee for the scheduled visit and those fees must be paid prior to the next scheduled visit.
FURTHER ALL FUTURE SCHEDULED VISITATION WILL BE PAID IN FULL 12 HOURS BEFORE ANY VISITS BY ZELLE.
A "NO SHOW" is defined as non-arrival with no previous call to WATCH director and/or private supervisor of status or improper cancellation of the visit.
___33. The visiting party will pay for all meals, snacks, drinks and admissions fees during the visit. The private supervisor will not pay for anything during the supervised visit.
___34. If private supervisor needs to cancel a scheduled supervised visit for any reason, both parties will be notified and the visit will be re-scheduled upon agreement of the parties involved.
___35. Neither party is to ask the private supervisor for any preferential treatment nor request any exceptions to the W.A.T.C.H. program rules. ALL requests requiring a change in the visitation schedule must be directed to the W.A.T.C.H. program director.
___36. The private supervisor and the W.A.T.C.H. program director’s responsibility is the safety of the children. If the private supervisor and the W.A.T.C.H. program director make a decision that is not stated in the Agreement for the protection and safety of the children, the parties shall abide by that decision. Failure to comply with all rules may result in immediate termination of all future visits.
___37. This agreement does not over ride any court ordered possession and access orders. If any conflict between the agreement and the court orders arise the court order controls.
___38. CP: I understand that The W.A.T.C.H. program, officers, employees and volunteers are not parties to the suit and are not ordered to provide supervised visitation, and reserve the right to terminate services for violations of the policies and services under the W.A.T.C.H. program
___39. Neither party has the permission of the W.A.T.C.H. program to record any of the conversations and/ or video or photograph between the parties and the child (ren) or the W.A.T.C.H. supervisor(s)
___40. NO FIREARMS will be permitted on the custodial or non-custodial party (person) or in the vehicle being used to transport the child(ren) and/or the private supervisor by non-custodial party during a supervised visit. The definition of "FIREARMS" is any weapon (including a starter gun) which will or is designed to or may readily be converted to expel a projectile by the action of any explosive. This includes any any explosive, incendiary or poison gas.
**Any changes in the Rules are subject to the W.A.T.C. H. director’s approval.
Both parties need to initial each rule, sign and date that you have read and understand the rules and regulations of the W.A.T.C. H. Program.
